Chapter 7

Chapter 13
Chapter 13 is a repayment plan. It can effectively deal with your debts when Chapter 7 is not possible or is not you in your best interest.
When is Chapter 13 the better option?
- You can’t catch up a car payment. And, you need your car;
- You are behind on your mortgage. And, you want to keep your house. Chapter 13 is available even if there is a foreclosure.
- Parking tickets, red light tickets and tollway debts can’t be wiped in Chapter 7. They can be discharged in Chapter 13.
- You owe Real Tax taxes. The taxes can be paid over time. This is true even if the taxes have been sold and the date of Redemption is coming up;
- Some but not all IRS debts can be wiped out in Chapter 7. Chapter 13 lets you pay the IRS over time;
- Some individuals have income far excess of the Means Test threshold. We have helped clients still pay a small dividend in Chapter 13;
- The timing of a prior Chapter 7 or Chapter 13 doesn’t allow Chapter 7 now. Chapter 13 is still available and usually with very small payments; and,
- There are other times when a Chapter 13 is a better fit for you.
